My hunting party was driving deer and I was one of
two hunters posted. A buck came out in thick small
trees. I only had a second to make a decision if it
was a legal buck or not. From what I seen, it had
at least three points on one side so I was positive
it was a legal deer. The deer started moving away
and I shot and killed him. When I reached the deer
I was surprised to see it was only a total of three
points. After tagging and bringing the deer home I
called the Game Commission informing them of a
mistake kill. They told me to bring it to
Lackawanna State Park Bear check in station so I
did. The officer twisted my story and said I was in
violation of taking a protected deer and that it was
not a mistake kill. So instead of getting a $25 fine
and keeping the deer he took my buck and fined me
$100 saying it was the smallest fine he could have
given me. The fine is really $147 after all costs
are added. I will go to court to fight this but I
here it's tough to beat them. I'm an honest hunter
and would never break the laws on purpose but this
is the last time I do the right thing when the Game
Commission is involved. Is there really such a
thing as a mistake kill or is this a scam to get
more fines?
